Introduction

These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Rapid Fuel Rescue LTD, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

Whilst Rapid Fuel Rescue LTD uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guarantee in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

11. Rapid Fuel Rescue LTD accepts no liability for any disruption or non-availability of the Website.

12. Rapid Fuel Rescue LTD reserves the right to alter, suspend, or discontinue any part (or the whole of) the Website including, but not limited to, any products and/or services available. Limitation of Liability

13. Nothing in these terms and conditions will: a. Limit or exclude our or your liability for death or personal injury resulting from negligence; b. Limit or exclude our or your liability for fraud or fraudulent misrepresentation; c. Limit or exclude any of our or your liabilities in any way not permitted under applicable law.

14. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

15. To the maximum extent permitted by law, Rapid Fuel Rescue LTD accepts no liability for: a. Any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities; b. Loss or corruption of any data, database, or software; c. Any special, indirect or consequential loss or damage.

Guarantee

16. Rapid Fuel Rescue LTD offers a 14-day service guarantee covering the quality and effectiveness of the fuel drain we carry out. This guarantee applies solely to issues arising from an incomplete or incorrect fuel drain performed by our technician. If it is found that the fuel drain was not completed properly and this has directly impacted your vehicle’s performance, we will return to rectify the issue at no additional cost.

Please note: This guarantee does not cover any damage or issues resulting from the customer having put the wrong fuel in their vehicle, either before or after our service. It is the customer’s responsibility to avoid further operation of the vehicle once the incorrect fuel has been added and to follow our instructions during and after the service. Any faults unrelated to the fuel drain itself, including engine damage, filter failure, or system contamination from running the engine with the wrong fuel, are not covered under this guarantee.

17. Whilst the utmost care is taken during fuel removal, in no event shall Rapid Fuel Rescue Ltd or its agents be held liable for any damage (including without limitation, damage to the casualty vehicle, engine or associated fuel system, accidents or illnesses) caused by misfuelling, our efforts in fuel evacuation, vehicle restart, or advice concerning the vehicle. As such, neither Rapid Fuel Rescue Ltd or its agents will be held liable for any damage or loss, either as a result of a pre-existing condition (known or unknown), as a result of the misfuel or attempts to start or drive the vehicle after a misfuel or as a result or our efforts to rectify a misfuel, successful or unsuccessful.

General

19. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

20. These terms and conditions may be varied by us from time to time. Revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the current version.

21. These terms and conditions, together with the Privacy Policy and Cookies Policy, contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions or agreements.

22. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions.

23. If any court or competent authority finds any provision of these terms to be invalid, illegal or unenforceable, that provision shall be deemed deleted without affecting the validity of the rest.

24. No delay or omission by either party in exercising any right or remedy will be deemed a waiver.

25. This Agreement shall be governed by and interpreted in accordance with the law of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the English and Welsh courts.

Cancellations

26. General Cancellation: Customers may cancel their service at any time. Cancellations made within 15 minutes of placing the order will be processed without charge.

27. Cancellation After 15 Minutes: If cancellation occurs after the first 15 minutes, a non-refundable deposit will be retained or deducted from any refund.

28. Exceptions: In cases of emergency or exceptional circumstances (with documentation), the deposit may be waived or adjusted at our discretion.

29. Change of Service Date: If rescheduling instead of cancelling, the deposit may be carried forward to the new booking date, subject to availability.
